Statutory Trademark Law

U.S. federal trademark law is found in chapter 22 of title 15 of the U.S. Code. The library has physical copies of official U.S. Code., the U.S. Code Annotated (West) and the U.S. Code Service (Lexis). (See the call numbers listed below to find these in the stacks.) Electronic versions are available through their respective publishers. HeinOnline offers full historic coverage of the U.S. Code, which can be useful when faced with an issue based on a previous trademark law.  Unlike its IP cousins, copyright and patent, trademark is also a matter of state law.  The codes of individual states should be consulted for how those jurisdictions manage their trademark issues.

Finding Patent Cases

One good way to find cases about patents is to start from a relevant patent statutory section (title 35 of the U.S. Code) in Westlaw or Lexis and use the database's annotation and citation features. Notes of Decisions in Westlaw (or Case Notes in Lexis) provide summaries from prominent cases. You can also use the Citing References tab in Westlaw (or Shepherd's in Lexis) to find additional cases that cite that section. You can also search patent cases using the links below:
