An urgent plea for much needed reforms to legal education The period from 2008 to 2018 was a lost decade for American law schools. Employment results were terrible. Applications and enrollment cratered. Revenue dropped precipitously and several law schools closed. Almost all law schools shrank in terms of students, faculty, and staff. A handful of schools even closed. Despite these dismal results, law school tuition outran inflation and student indebtedness exploded, creating a truly toxic brew of higher costs for worse results. The election of Donald Trump in 2016 and the subsequent role of hero-lawyers in the ?resistance? has made law school relevant again and applications have increased. However, despite the strong early returns, we still have no idea whether law schools are out of the woods or not. If the Trump Bump is temporary or does not result in steady enrollment increases, more schools will close. But if it does last, we face another danger. We tend to hope that crises bring about a process of creative destruction, where a downturn causes some businesses to fail and other businesses to adapt. And some of the reforms needed at law schools are obvious: tuition fees need to come down, teaching practices need to change, there should be greater regulations on law schools that fail to deliver on employment and bar passage. Ironically, the opposite has happened for law schools: they suffered a harrowing, near-death experience and the survivors look like they?re going to exhale gratefully and then go back to doing exactly what led them into the crisis in the first place. The urgency of this book is to convince law school stakeholders (faculty, students, applicants, graduates, and regulators) not to just return to business as usual if the Trump Bump proves to be permanent. We have come too far, through too much, to just shrug our shoulders and move on.

This new book on teaching law draws upon the wisdom of hundreds of legal educators to provide ideas, materials, and alternatives for teaching a variety of law school courses. The book offers guidance for new and experienced law teachers to plan and deliver effective courses. From Business Associations to Family Law, Federal Income Taxation to Torts, each chapter addresses one of the fifteen courses most students take during their legal education. Each chapter has five sections: (1) Approach, encompassing global issues about a course, such as goals, organizational scheme, general philosophy, syllabi, and coverage; (2) Materials, evaluating what kinds of materials enhance a course; (3) Class Exercises, evaluating what teaching and learning activities work well in a course and suggesting in- and out-of-class projects that promote learning; (4) Brief Gems, in which teachers share devices and ideas that have proven effective in their classes; and (5) Evaluation of Students, assessing when and how students should be evaluated and discussing teachers' thoughts on feedback and assessment both during and at the end of the course.

Outcomes Assessment for Law Schools focuses on using student feedback given through an independent facilitator to modify and improve the assessment process.

Best Practices for Legal Education provides a vision of what legal education might become if legal educators step back and consider how they can most effectively prepare students for the practice of law. It can help law school applicants and law students ask key questions about prospective law schools' commitment to educating them to be effective, ethical lawyers. It can assist law schools and universities by serving as a road map for a partial or complete review of a law school's program of instruction. It can help individual teachers improve course design, delivery of instruction, and assessment of student learning.

Teaching Law re-imagines law school teaching and scholarship by going beyond crises now besetting the legal academy and examining deeper and longer-lasting challenges. The book argues that the legal academy has long neglected the need to focus teaching and scholarship on the ideals of justice that law fitfully serves, the political origins of law, and the development of a respectful but critical relationship with the legal profession. It suggests reforms to improve the quality of legal education and responds to concerns that law schools eschew the study of justice, rendering students amoralist; that law schools slight the political sources of law, particularly in legislative action; and that law schools have ignored the profession entirely. These areas of neglect have impoverished legal teaching and scholarship as the academy is refashioned in response to current financial exigencies, and addressing them is long overdue.

Building on Best Practices is a follow-up to Best Practices for Legal Education, a project of the Clinical Legal Education Association (CLEA), authored primarily by Roy Stuckey. With contributions from more than 50 legal educators, this new volume is not a second edition, but is intended to be used in conjunction with the original volume, as the core content of Best Practices remains just as useful as when it was originally published. In the wake of new ABA Accreditation Standards, the MacCrate Report, and other changes, legal education is called upon today to respond to a broader view of what lawyers must be trained to do. Building on Best Practices identifies ten such areas and provides guidance on what and how to teach them. The demand to teach a broader range of knowledge, skills, and values presents difficult trade-offs, however, that are also considered.
